AN ORDINANCE TO REVISE A LICENSE FEE WHICH WAS PRESCRIBED BY ORDINANCE #1851.

            WHEREAS, Hermann Municipal Code Ordinance #1851, passed on June 27, 2011, imposes a fee as follows:

For the privilege of selling to duly licensed wholesalers and soliciting orders for the sale of malt liquor containing not in excess of five percent of alcohol by weight, to, by and through a duly licensed wholesaler within this state, the sum of one hundred dollars ($100.00); and

            WHEREAS, the State of Missouri charges a fee of $50.00 for this privilege; and

            WHEREAS, the City wishes to reduce its fee for said license from $100.00 to $75.00; and

            WHEREAS, the Board of Aldermen has determined that revising said Ordinance Section as provided herein would serve a legitimate public purpose and is in the best interests of the citizens of the City of Hermann, Missouri.

            NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF HERMANN, MISSOURI, AS FOLLOWS:

            SECTION ONE:  Subsection (A)(4) as provided in Ordinance #1851is hereby revoked in its entirety and a new Subsection shall be substituted in lieu thereof to read as follows:

4.   For the privilege of selling to duly licensed wholesalers and soliciting orders for the sale of malt liquor containing not in excess of five percent of alcohol by weight, to, by and through a duly licensed wholesaler within this state, the sum of seventy-five dollars ($75.00); and

SECTION TWO:  All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.

            SECTION THREE:  This Ordinance shall be in full force and effect from and after its passage and adoption.

SECTION FOUR:  The publisher of the City of Hermann ordinances shall be permitted to re-designate the section or sub-section number of this revised code section to fit within an appropriate portion of the Hermann City Code, within the discretion of the publisher.
